Realty Times - California REALTORS? Change The Rules For Short ...

Directors of the California Association of Realtors? (CAR) recently voted to amend the state model MLS rules as they apply to short sales. Those rules had provided that the offer of compensation by the listing broker to potential cooperating brokers (i.e. buyers' agents) could be conditional.

So, for example, a short sale listing might have stated that a successful buyer's agent would receive a 2.5% commission, BUT that commission offer was conditioned upon the short sale lender's approval. The private agent-only listing remarks might have said something like this: "Commissions are subject to lender approval. If the commission is reduced by the lender, the reduced commission will be split 50-50." That way, if the lender would only allow a 4% commission, each would receive 2%. The listing agent wouldn't be bound by the offer of 2.5%, leaving her with only 1.5%.

In general, the offer of compensation through a multiple listing service (MLS) is not allowed to be conditional. As the California model rules put it: "The amount of compensation offered through the MLS may not contain any provision that varies the amount of compensation offered based on conditions precedent or subsequent or on any performance, activity, or event."

Over the years, exceptions have been allowed for such things as probate sales and bankruptcy proceedings, where a court may change the commission originally negotiated between the listing broker and the seller. In recent years, as indicated above, an exception has been allowed for short sales as well.

Now, however, the CAR directors have voted to remove this exception from the state's model MLS rules. Under those model rules, short sale offers of compensation must be unconditional. Short sale listing agents will just have to make their best estimation as to what the final approved commission will be and how much they want to offer to the cooperating broker.

Why would the CAR directors vote this way? In a nutshell, it is because those directors and their constituents are fed up with the manner in which many (certainly not all) short sale listing agents have gamed the system.

We have discussed this problem before (August 30, 2011). There are too many variations to enumerate here. What they have in common is that the language in the conditioning remarks is not only frequently misleading but also stated in such a way as to guarantee that, if a commission is reduced, the listing agent will receive the lion's share, often substantially larger than that of the buyer's agent.

In debate some expressed concern that requiring an unconditional offer of compensation would simply result in buyers' agents being offered a very low commission split. The response to that was simply that the buyer's agent could then make an informed choice as to whether he or she would show that listing. The practice also might lead to a wider use of buyer-broker compensation agreements.

Much has been made of agents' dissatisfaction levels with the behavior of lenders in short sale situations. What was revealed at the recent CAR meetings is that there is also a lot of agent-to-agent dissatisfaction in the short sale scene.

The change we have been discussing was made to California's model MLS rules. Local MLS organizations are not required to adopt those rules, though most probably do. Playing by the same set of rules facilitates interaction between the members of different MLSs, and, in some cases, adopting the model rules may be an issue affecting an MLS's ability to obtain insurance coverage.

The change in California's model rules will be considered by local and regional MLS organizations. The debates are likely to be heated and close. At CAR more than 600 directors participated in the discussion and vote. Only twenty-nine votes separated the yays from the nays.

Ad Age Speculates On Online Poker Advertising Boom

With online poker?set to roll out in Nevada over the next few months, industry experts are predicting other states will follow suit and create a new online gambling advertising boom.

According to?Ad Age, a trade publication that focusing on marketing and media data and analysis, online gambling companies will spend somewhere in the neighborhood of $3.5 to $4 billion over the next five years.

To put that number in perspective, Ad Age points out that $4 billion is more than General Motors spent in U.S. advertising in 2011. According to this?Word Stream infographic, that?s equal to what the entire finance and insurance industry spent on Google ads in 2011, and twice that of the computers and consumer electronics industry.

However, a significant roadblock to this boom is Google?s?current rules in place regarding casinos and gambling. In the U.S., Google advertising policy ?doesn?t allow advertising for Internet-based games where money or other items of value are paid or wagered in order to win a greater sum of money or other item of value.? Google?s total advertising revenue for full year 2011, according to its income statement, totaled $36.5 billion.

Simon Holliday, Director at H2 Gambling Capital, believes that the online gambling market will be worth $1 billion in 2014 and more than $13 billion in ten years. Holliday was also quick to point out just how much advertising spending will eat into the industry.

?It is probable that 25 percent to 30 percent of company net revenues will be spent on advertising and marketing budgets in the initial years, as there is a land grab,? said Holliday.

Though?Delaware remains as the only other state to legalize online poker, some experts believe that others are waiting to see how successful Nevada is with their product before jumping on board. Other states that have looked at online poker include California, New Jersey and Iowa.

In aftermath of drought, U.S. corn movement turns upside down

CHICAGO (Reuters) - The devastating U.S. drought and ensuing crop disease are upending traditional grain movement patterns, with dozens of trains and barges shipping North Dakota or Mississippi corn into the Corn Belt rather than out to the coasts.

Processors and ethanol producers in No. 2 corn state Illinois, where the average corn yield was the lowest in nearly 25 years, are "importing" millions of bushels of the grain - an unprecedented volume - from North Dakota, which produced a record crop this year, trade sources said. Northern corn is even reaching key livestock states such as Texas and Oklahoma.

Some southern states, which were also spared the worst of the most extensive drought in half a century this year, are shipping barges of corn up the Mississippi River to the interior, reversing the normal trade flow, traders say.

While atypical shipments are not unheard of in the agricultural market, traders say the scale of this year's upheaval is unprecedented. It is being fueled both by the dramatic difference between drought-hit Midwest crops and bumper harvests in fringe states, as well as the prevalence of a naturally occurring toxin, aflatoxin, that can harm livestock.

The unusual grain flow could foreshadow a scramble for quality corn supplies in the months to come as end-users work through the smallest U.S. harvest in six years. By next September, corn stocks are projected to drop to just 5.5 percent of annual demand, the bare minimum of operational requirements.

The market dislocations could benefit logistics firms and big merchants such as Cargill, which reported a four-fold rise in earnings this month and said "atypical trade flows" would spur more demand for its trading expertise.

Railway companies, which are already reaping windfall profits from upheaval in the oil market, are also moving quickly to take advantage of the scramble in grain trading.

BNSF Railway last month posted rates on its website for shuttle services from Minnesota and the Dakotas to Illinois, which traders said was a first for the route. BNSF said it changes rates based on consumer demand and market conditions but declined to comment further.

Canadian Pacific Railroad has responded to "increased demand for corn from the Northern Plains to be moved to eastern parts of the country", a spokesman said, declining further comment.

QUALITY ON THE FRINGES OF THE CORN BELT

Signs of a supply squeeze were already evident in global trading patterns, with U.S. livestock producers booking corn from Brazil in the wake of soaring feed costs.

But they have become more evident in the cash market for U.S. grains since the Midwest harvest began in September, illuminating the uneven impact of the drought.

The average 2012 corn yield in Illinois is projected at 98 bushels per acre, a 24-year low. By contrast, producers at the edges of the Corn Belt grew record or near-record crops with excellent quality. Production in North Dakota surged 80 percent; Mississippi's yield jumped to a record high.

"Test weights are fantastic. We have never seen corn like this in our lives," said David Fiebiger, manager of the Finley Farmers Elevator in North Dakota, a shuttle-loading facility that has dispatched one train of corn to the Midwest.

In Hillsboro, North Dakota, Cory Tryan, manager of the Alton Grain Terminal, said only one of the 10 shuttle trains loaded with corn from his facility this autumn - carrying a total of about 4 million bushels, or 1 percent of the state's corn crop - was shipped to the Pacific Northwest export market. Normally all his corn is shipped to Asia.

Tryan said the remaining nine were being rerouted to Decatur, Illinois, and St. Louis, Missouri, among other Midwest destinations.

"We were fortunate to have corn quality and good yields that are helping fill the void to our south," Tryan said.

Decatur is home to agricultural powerhouse Archer Daniels Midland Co, while London-based Tate & Lyle, a sweetener maker, also has a plant there. Neither company would comment for this story.

One source in the cash grain market estimated that as many as two to three shuttle trains of corn, which carry about 400,000 bushels each, are arriving daily in Decatur, shipped from the Dakotas or Minnesota, a record volume.

AFLATOXIN

On top of production shortfalls, grain handlers in several top corn states are struggling with outbreaks of aflatoxin, a byproduct of the drought. Aflatoxin can cause liver disease and is considered carcinogenic. Federal guidelines limit aflatoxin concentrations to fewer than 20 parts per billion in human food, while the threshold for milk is even lower, at 0.5 ppb.

Aflatoxin, which attacks drought-stressed corn, hit hard in the southern half of the Corn Belt, including central and southern Illinois.

As a result, ethanol distillers as well as other processors in the region have been on edge. Mike Hall, president of MLH Futures in Litchfield, Illinois, said corn arriving into St. Louis was likely earmarked for ethanol plants.

Aflatoxin is a problem for ethanol distillers because any contamination in corn becomes more highly concentrated in dried distillers' grains, an ethanol byproduct that is sold as animal feed and serves as a key part of ethanol plants' profit margins.

Because corn from the Dakotas and Minnesota is virtually free of aflatoxin, brokers said, end-users of the grain have been paying up for it, effectively creating a two-tiered market. Clean corn from the northern states delivered into central Illinois costs roughly 20 to 30 cents per bushel more than corn bought locally.

"They are paying a premium to get corn without aflatoxin. That's why they want that corn," Hall said.

SOUTHERN CORN BARGING NORTHWARD

The movement of northern corn marked the second wave of corn brought into the core Midwest from the fringes of the grain belt. Roughly 80 to 100 barges carrying 4 million to 5 million bushels of corn were shipped up the Mississippi River and into the Illinois River in late August and early September, said Roy Huckabay of the Linn Group, a Chicago brokerage.

The bumper corn harvest in Mississippi and Louisiana created big discounts at that time in the local cash market, allowing Midwestern buyers to pay to ship the grain upriver. Southern corn occasionally moves northward but rarely in as large a volume, a barge source said.

The corn was unloaded in Havana, Illinois, and moved to Tate & Lyle elevators, Huckabay said, although he added that the buyer was not necessarily Tate & Lyle.

"There was a huge discount because they had so much corn down there, they had such great yields and nowhere to go with it," the barge source said, noting poor export demand. "So it definitely worked this year, versus normal years."

Diana Klemme, vice president of Grain Service Corp in Atlanta, which advises grain buyers and sellers on marketing and risk strategies, said atypical patterns of grain movement are likely to continue as corn buyers work to cover their needs until the next harvest.

"My word to customers," she said, "is to keep your eyes and ears open and talk to people you have not talked to in years, because you don't know where the next deal is going to come from."

Routine electrocardiograms predict health risks for patients with atrial fibrillation

ScienceDaily (Oct. 28, 2012) ? Canadian scientists have determined that routine electrocardiogram (ECG) results for patients with atrial fibrillation (AF) -- the most common form of irregular heart beat -- can help doctors identify those at higher risk of adverse cardiovascular outcomes, including death. This knowledge will help doctors improve the treatment and prognosis of atrial fibrillation.

Through a retrospective analysis of thousands of patient files, researchers at the Montreal Heart Institute and the University of Calgary learned that a routine 12-lead surface ECG -- in which 12 different electrical signals are recorded -- conducted at the time of AF diagnosis is an accurate predictor of later adverse events.

Research presented October 28 at the Canadian Cardiovascular Congress found that patients with AF do not all face the same risks for disease; determining the extent to which any individual patient is at risk of adverse events has been a challenge for doctors, until now.

"The ECG has recently received resurging attention due to its simplicity, relatively cheap cost and near universal availability," says Dr. Jason Andrade, cardiologist at the Montreal Heart Institute. "This knowledge, combined with the recognition that all patients with AF will receive an ECG as part of their diagnostic work-up, makes it highly useful as a method for assessing risk."

ECG is used to measure the rate and regularity of heartbeats, as well as the size and position of the chambers, the presence of any damage to the heart and the effects of drugs or devices used to regulate the heart, such as a pacemaker

Researchers found that the strongest indicators of risk were prolonged QRS duration and prolonged PR and QT intervals, each of which is a measure of electrical waves that regulate heart rhythm.

For example, a prolonged QRS duration is associated with an increased risk of multiple adverse cardiovascular outcomes including death and hospitalization.

An increased PR interval is associated with cardiovascular death and sudden cardiac death. A prolonged corrected QT interval is associated with an increased risk of cardiovascular hospitalization and sudden arrhythmic death in men.

Dr. Andrade noted that the research team was "somewhat surprised at the strength of the relationship between the identified ECG predictors and the adverse cardiovascular outcomes."

Their data analysis showed that a prolonged QRS duration was associated with a 40 per cent increased risk for all-cause mortality, a 50 to 60 per cent increased risk for cardiovascular mortality and a 90 to 120 per cent increased risk for sudden cardiac death.

It is estimated that 350,000 Canadians live with AF, and that rate is likely climbing as the population ages. Those with AF are three to five times more likely to suffer a stroke, the majority of which are disabling and are more likely to be fatal. However, prevention is effective at reducing the risks associated with AF.

Atrial fibrillation (AF), a type of irregular heart rhythm known as an arrhythmia, can cause the heart to beat very fast, sometimes more than 150 beats per minute. While it is rare in people under 40, its prevalence increases with age.

"Knowing that the risk of developing AF increases with age and with other risk factors such as diabetes, high blood pressure and underlying heart disease, it is important to take action by following a healthy lifestyle to start reducing your risk," says Heart and Stroke Foundation spokesperson Dr. Beth Abramson. "Your risk for developing many diseases can be reduced if your diet is lower in sodium, saturated and trans fats and includes plenty of vegetables, fruit and whole grains."

She says that if you have a tendency to high blood pressure -- which is associated with AF -- then regular activity, watching salt in your diet and maintaining a healthy body weight are especially important preventive measures.

Dr. Abramson also recommends being tobacco-free, limiting alcohol intake and reducing stress as much as possible. "Any lifestyle changes that lower blood pressure may reduce your chances of developing AF," she adds.

Insurer subsidiary lifts Loews Corp. 3Q profit

NEW YORK (AP) ? Loews Corp. said on Monday that its third-quarter net income rose 9 percent as improving performance at the diversified holding company's CNA Financial insurance subsidiary offset lower earnings at deepwater driller Diamond Offshore Drilling.

Loews reported net income of $177 million, or 45 cents per share, for the three months ended Sept. 30. That was up from earnings of $162 million, or 40 cents per share, in the same period a year ago.

Excluding a $166 million charge writing down the value of a subsidiary's natural gas properties because of declining natural gas prices, Loews earned $339 million, up from adjusted earnings of $177 million a year ago.

Revenue rose 8 percent to $3.72 billion from $3.44 billion.

Loews, which is controlled by New York's Tisch family, reported net income of $195 million at CNA Financial, more than double the $84 million that CNA reported in the year-ago period. That subsidiary, 90 percent owned by Loews, reported higher net investment income and lower catastrophe losses.

But at the Diamond Offshore Drilling unit, about half of which is owned by Loews, earnings fell 31 percent to $83 million from $121 million.

Loews also owns a 55 percent interest in Boardwalk Pipeline Partners, and HighMount Exploration & Production and Loews Hotels are wholly-owned subsidiaries.

Manage Context Menu items with Right Click Enhancer

If you install lots of software on your system you may have noticed that the Windows Explorer right-click context menu has grown considerable in size ever since you started to install software on your computer. Many applications add their own items to the context menu which help you run specific features faster. You can for instance send a selected file directly to your virus scanner for testing, or load selected media files with your favorite media player.

It quickly becomes a problem once items are added that you do not use at all. The result is a cluttered context menu that is displaying too many items and slowing you down as a consequence.

Right Click Enhancer is a free portable software program for the Windows operating system that makes available a set of tools to tame the context menu. The program not only lets you remove items with ease, it also enables you to add useful items or program shortcuts to the context menu.

The program displays a number of options on start which may be confusing at first. There is for instance a right click editor and a simple right click editor, and it is not really clear what the difference is between the two tools. Here is a quick rundown of all tools and the functionality they make available:

  • Right Click Tweaker ? This tool enables you to add new commands to the Windows Explorer context menu. From opening an administrative command prompt over printing a file list, taking ownership or copying the selected contents to the clipboard.
  • My Computer Manager ? Enables you to add files or folders to the My Computer context menu.
  • Right Click Shortcuts Creator ? You can use this tool to add file or folder shortcuts to the right-click context menu in Windows Explorer. All shortcuts are placed into the root folder automatically.
  • Right Click Cascading Menu Creator -? Does the same as the Right Click Shortcuts Creator, only that you place the file or folder shortcuts into subfolders which may improve visibility if you plan to add several shortcuts to the menu.
  • Right Click Editor ? Displays all existing file types and their associated actions. You can add, remove or edit actions here
  • Right Click Editor IE ? You can edit Internet Explorer?s context menu here.
  • Send To Manager -? Add or remove devices, folders or services in the Send To folder.
  • New Menu Editor ? Add or remove files that you can create when you select the New option in Windows Explorer.
  • Simple Right Click Editor ? Displays context menu commands and their actions. You can use it to remove actions from the menu.

We have been hearing a lot, more recently, about the imprtance of vitamin D. Here is a great article that was in Experience Life Magazine, which is the magazine of Lifetime Fitness.

How correcting a serious vitamin-D deficiency helped one woman transform her life.

For years, Susan Zemke had done everything right. The lean 60-year-old worked out regularly with a personal trainer; ate a healthy, balanced diet; and made sure to get regular health checkups. But in 2010 she was slowly putting on weight and felt sluggish. Once, she even blacked out during a training session. ?I felt rotten,? she remembers. ?And I just couldn?t figure out what was going on.?

At first, Zemke believed she might simply need more substantial foods. But adding more sources of protein, such as eggs and meat, didn?t improve matters. Perplexed but determined to get to the bottom of her mysterious ailments, Zemke began looking for ways to dig deeper into the problem.

At the time, Zemke was working with Cliff Edberg, a personal trainer and registered dietitian at the Life Time Fitness in Chanhassen, Minn. He suggested a series of tests for Zemke, including a complete blood count and screens that would evaluate key nutritional factors, such as the amount of iron and vitamin D3 in her system.

When the results came back, Edberg saw a bright red flag: Zemke?s vitamin-D levels hovered at just 40 nanograms per milliliter (ng/ml). Though many doctors (including Zemke?s) don?t bother advising patients to make changes until their vitamin-D levels dip into the 30s, a range of 50 to 70 is more typical for optimal health (100 ng/ml is considered the upper limit of safe levels).

?I felt that improving that status could help improve her mood, her energy and her overall well-being,? says Edberg.

For Zemke, the findings were jarring. She knew of plenty of reasons for poor health ? smoking, inactivity, high cholesterol ? but a vitamin-D deficiency never would have made her list. ?I had never realized how significant it was,? she says. ?Nobody had mentioned vitamin D to me, ever.? She read up on the research and was floored to discover that vitamin-D deficiencies are a widespread problem.

A recent CDC report indicated that one-third of Americans aren?t getting enough of the vitamin. One quarter were at risk of vitamin D ?inadequacy? (levels between 30 and 49) and 8 percent were at risk of deficiency. Individuals with darker skin tones are even more likely to be low than those with lighter skin.

It?s a troubling statistic, because studies have linked low levels of vitamin D with everything from obesity to problems with mental clarity. Other research has shown that increasing vitamin-D levels can help reduce insulin resistance, protect against Crohn?s disease and enhance the immune system. A Better Balance

To counteract her shortages, Zemke began taking a daily 1000-IU (international unit) dose of vitamin D. ?Within a month,? says Zemke, ?I felt 100 percent better.? After six weeks, her levels were up over 70. She had more energy and more vitality, and felt happier, too.

Zemke?s vastly improved health began to open up new training options for her. Instead of focusing on just getting better, she and Edberg began working on the goal of getting her stronger.

For months, throughout the winter and spring, the fix seemed perfect. She got her levels tested every four to six weeks to make sure she was on track. Then, suddenly, in the summer of 2011, her levels spiked to 118.

Although Zemke hadn?t noticed any problems, she learned that in some people, levels above 110 can lead to a range of symptoms, including constipation, vomiting and heart-rhythm abnormalities, and can result in long-term bone and kidney damage.

Edberg advised her to cease her supplementation regimen for the summer, suspecting that all the extra time Zemke was spending enjoying the outdoors might be the culprit. And he was right.

Vitamin D is often called ?the sunshine vitamin,? and for good reason. Though it?s rarely found naturally in foods, people often get the required amount just by spending some time outside. Zemke?s supplement provided just the right amount of vitamin D when she was inside during cold-weather months, but caused her levels to climb too high in warmer months when she spent more time outside working on her yard or taking long walks in the local arboretum.

?Seeing someone get above the recommended amount of vitamin D at a relatively low dosage like this is very uncommon,? says Edberg, ?but it?s not entirely surprising when you consider that the sun was always intended to be our primary source of vitamin D.?

A simple adjustment in Zemke?s supplementation was all it took to get her levels back to normal very quickly.

These days, she customizes her vitamin-D supplementation based on her daily plans. ?During the week, when I spend most of my time in the office, I take a supplement,? she says. ?But on the weekends, when I like to be outside, I don?t.?

Zemke also considers factors like whether or not she is wearing sunscreen, and how much skin exposure she?ll likely have that day.

She appears to be getting the formula right: Today, her vitamin-D levels hover between 80 and 100 ng/ml. But she still gets her lab tests every six months just to be safe. Edberg notes that there is a good deal of variability in how well individuals absorb vitamin D, and how they assimilate it under varying circumstances. ?That?s why the best way to optimize your vitamin-D levels is to test to get a baseline, get some sun or take some vitamin D, then retest your levels a few weeks later and adjust your approach accordingly.?

Beyond the Numbers

Over the past several months, Zemke has continued to refine her diet and exercise regimen, and to make solid fitness gains. But she credits her vitamin-D testing as the catalyst that vaulted her health and fitness to a new level and gave her the motivation to pursue new goals.

When Edberg proposed that Zemke enter the ?figure? category in a bodybuilding competition, she initially scoffed ? and then reconsidered, eventually taking him up on the idea. In the four competitions in which she?s participated, she?s placed as high as second in her division, often besting competitors nearly half her age.

From Zemke?s point of view, it?s all a testament to the power of information. ?If it weren?t for that important piece of vitamin-D data,? she says, ?I would have just gone on my way thinking I would be OK. But I wasn?t OK. And without that information, I never could have gotten to the place I needed to be.?

Indonesia arrests 11 suspected militants over U.S. embassy plot

JAKARTA (Reuters) - Indonesia's anti-terrorist squad arrested 11 suspected Islamic militants it said planned to attack the U.S. embassy, a plaza near Australia's embassy and the offices of Freeport-McMoRan Copper & Gold, a police spokesman said on Saturday.

The Detachment 88 squad seized bomb-making equipment and one bomb ready to be used by a new militant group called Harakah Sunni for the Indonesian Society (HASMI), said National Police spokesman Suhardi Alius in a statement.

The arrests by the elite police squad on the island of Java were the latest step in a crackdown by authorities against militants during which dozens have been arrested and at least seven killed.

They come 10 years this month after a bomb attack on Bali killed 202 people, most of whom foreign tourists.

"The first piece of evidence was found at a housing complex in Madiun (Java), a bomb ready to detonate, as well as raw materials for bomb making and instruction books on how to make bombs," Alius said, before listing other evidence of explosives.

He gave no further details about the group's identity.

He listed targets as the U.S. consulate in Surabaya, East Java, its embassy in Jakarta, Plaza 89 in Jakarta, which is in front of the Australian embassy, and the offices of mining company Freeport.

HASMI also planned to attack the Mobile Police Brigade in the central Java city of Srondol, he said.

"We have seen the reports, but cannot comment as this is an ongoing Indonesian security investigation," a State Department spokeswoman in Washington said in an emailed statement to Reuters.

A spokeswoman for the U.S. Defense Department said she was unaware of any request by the State Department to increase security at its embassy in Jakarta in response to the reported arrests.

The Bali bombings, which in turn came just over a year after the September 11 attacks on the United States, were a watershed for Indonesia, the country with the world's largest population of Muslims.

They forced the secular state to confront the presence of a small but dedicated group of followers of Osama bin Laden bent on attacking Western targets.

After 2002, Indonesian forces worked with Australia and other countries to crack down on the al Qaeda-linked Southeast Asian militant group Jemiah Islamiah that was behind the bombs.

The hunt led to the arrest of hundreds of militants. Many were killed in shootouts and the three main perpetrators of the bombings were convicted and executed by firing squad in 2008.

Police investigate murder of ExxonMobil executive

Police in Belgium are investigating the murder of a British oil executive who was shot and killed in front of his wife in Brussels in mid-October.

Nicholas Mockford, a 59-year-old executive for ExxonMobil, the world?s largest oil company, was shot dead on Oct. 14 as he left a restaurant in Neder-over-Heembeek in northern Brussels. He died on the way to the hospital, police said.

In the immediate aftermath of Mockford?s murder, a judge imposed an order on police preventing them from releasing any details on the case or their investigation. But on Thursday, authorities decided to enlist the public?s help and released a brief description of the crime.

Mockford and his wife left the restaurant at about 10 p.m., the report said. They crossed the street toward a car when an assailant approached and hit Mockford?s wife several times in the face and tried to yank her bag away, police said.

A second assailant then fired three shots at Mockford who later died at the scene, police said.

Authorities were initially investigating the case as a botched carjacking, Reuters reported, but in the days following Mockford?s murder, family members said they believed he may have been the victim of a professional hit by an assassin.

A police spokesperson said officers were approaching the ?difficult investigation? from several angles, after Mockford?s relatives reportedly raised fears that he had been targeted for assassination, the Independent reported.

?He was shot so calmly and so quickly, it smacks horribly of a professional hit, but we can?t fathom why,? the relative told the Independent. ?He isn?t? the type to cave in to blackmail and it just doesn?t compute.?

Prosecutors declined to say if they were investigating the case as a possible contract killing and declined to comment further on the details or circumstances of the case until the perpetrators were caught. ?

Mockford was a manager within the chemicals unit at ExxonMobil and had worked over a period of 38 years in Britain, Belgium and Singapore, Reuters reported.

Oil giant ExxonMobil said Friday it did not believe the murder, was linked to Mockford?s work.

?We were shocked by the tragic death of Nick Mockford, one of our employees, a fortnight ago in Burssels,? the Texas-based company said in a statement. ?Mr. Mockford was a department manager at our office close to Brussels but we have no indication that the incident was work related.?

Brussels police said their "difficult"?investigation remains open.?

?We are investigating all different angles, and it depends on how quickly we can find elements of information," Genevieve Seressia, a spokesperson for the Brussels prosecutor's office said. "It?s impossible to predict how long this can take ? it might be handled quickly, but could take a long time, even years.??

Panic as magnitude-5 earthquake rattles Italy

ROME -- A hospital was evacuated after a magnitude-5 earthquake struck southern Italy early on Friday, authorities said.

The quake hit at 1:05 a.m. local time (7:05 p.m. ET Thursday) about 3.9 miles underground, north of Cosenza in the Pollino mountains area on the border of the southern regions of Calabria and Basilicata, according to data from the Italian Geophysics Institute (INGV).

At least 14 other tremors followed the initial earthquake, according to INGV's website.

Italian media reported that an elderly man who lived near the tremor's epicenter had died of a heart attack.

An Italian police official told Reuters a hospital in the small town of Mormanno had been evacuated as a precautionary measure because some cracks were found in its structure.

No injuries were reported, the official said.

Scientists convicted of manslaughter for not predicting quake

Italian news agencies reported scenes of panic in the hospital and said many inhabitants of Mormanno and surrounding towns had come out in the streets.

Police and firefighters were surveying the area for further damage, officials said.
